MINUTES Joe Bonner moved that the July 29, 2024 minutes be accepted. Bill Deters seconded the motion. Motion carried 100%. (5-0) Joe Bonner moved that the Special Meeting Adjustment to Address Fire/EMS Levy minutes be accepted. Bill Deters seconded the motion. Motion carried 100%. (5-0) TREASURER’S REPORT The Treasurer’s Report is available at the Village office. PAY THE BILLS Fran Romweber made a motion to pay the bills. Bev Bolser seconded the motion. Motion carried 100%. (5-0) MAINTENANCE SUPERVISOR’S REPORT Nate stated the roadwork on Turnberry, St. Annes and Eagles Cliff has begun and will be completed within two days. Julius Howe Asphalt Company will seal the repairs. Our maintenance crew removed one of the old docks at the WHH Riverfront Park. Our seasonal employee’s last day is August 30, 2024. DEPUTY CLERK’S REPORT Marilyn stated our We Thrive meeting is on August 28 at 1:00pm at Miami Township. All of our fire extinguishers have been inspected by FES on August 14, 2024. They either passed inspection or were replaced, which is required after six years. We also had our fire inspection of our buildings by Miami Township Fire Department on August 16, 2024 and passed that inspection as well. Minutes, August 19, 2024 DEPUTY CLERK’S REPORT, Continued Marilyn will meet with Ms. Diana Woolf, representative with PEP on August 28, 2024 for an inspection of our buildings and surrounding areas for risk prevention insurance purposes. Our Natural Gas Aggregation agreement has been signed and is in effect until October, 2025. The WHH Park Advisory Board met with Brownstone Design on a new logo for our park. We should have a final design by the end of September. The brush/grass at 154 Miami Avenue and 11 W. Harrison was cut on August 12 by the prospective new owners. Jim Searcy waters all of our planters and has noticed hundreds of honey bees around our hanging planters. He wanted council to know we are helping the environment. POLICE REPORT Sgt. Carney reported there were 37 calls for service for the month of July. There were two criminal reports (possession of drugs and theft); one case was assigned to detectives for investigation. There were 28 non-billable calls for service and two auto accidents. Mayor Sammons stated that Aston Oaks residents are concerned about speeding in the area. Sgt. Carney stated they have a speed trailer that is assigned to North Bend for two weeks and asked where council would like it placed. After a discussion they decided to place it on St. Annes at Turnberry for one week and then place it on Aston Oaks Drive after the stop sign at Stratford for the second week. Sgt. Carney also said they have rubber speed bumps which can be placed at these locations or council can lower the speed limit in Aston Oaks. GUESTS No Report. FIRE REPORT Mayor Sammons read Miami Township’s Fire Report. There were twelve incidents in North Bend for the month of July. There was one fire detail, eight EMS runs, and three other service calls. Mayor Sammons asked Marilyn to have a Miami Township representative attend our next meeting on September 23, 2024. THREE RIVERS SCHOOL Superintendent Ault said today is Three Rivers School fourth day of school. Their first home football game is Friday. Dr. Ault stated he is satisfied with their financial statement; TRS purchased bonds in 2013 and saved tax payers $800,000. Ms. Cailyn Schira, a TRS art student, earned a coveted spot in the Ohio House of Representatives Art Exhibition in Columbus, Ohio. Her art will be on display from August, 2024 to April, 2026. Taylor grad, Duke Heller, will be honored during the Navy Cross Ceremony on August 28 to celebrate his bravery and courage in the line of duty. TRS has three new staff members. They currently have 1,982 students which is down 38 students from last year. Joe Bonner asked if TRS fail any students. Dr. Ault stated they do not fail students in elementary school. If there are problems, they try to catch them early. COMMITTEES: Finance - Mr. Moorman There was a discussion of the WHH Riverfront Park Funding. Dave distributed a handout listing information on Grant Application Prioritization and a Park Funding Policy. Dave asked council how much in-kind money are we willing to spend? We may have already spent $100,000; ($50,000 from ARPA and $50,000 from the general fund). Dave stated when something unexpected happens, we need to have a reserve. Could the CIC money be used for reimbursing? The WHH Riverfront Park Advisory Committee will discuss setting expense guardrail limits at the September Advisory Committee meeting. Minutes, August 19, 2024 Finance, Continued Mayor Sammons stated FEMA has plans in place to help communities affected by floods; our insurance coverage would also be in place. Skip Holmes, Project Manager of the WHH Park, asked Scott Sollmann if the CIC could maintain a WHH Riverfront Park reserve and Scott stated the CIC could in fact maintain a reserve. Mayor Sammons stated the WHH Park is part of the Village and we knew that when we acquired the property with grant monies. Labor to maintain the park is part of our cost. Mayor Sammons likes having a buffer of laborers. Mark Weadick asked if our general fund has enough for the demands of the park. It’s difficult to reimburse the general fund. There was a discussion of the ARPA funds. Skip Holmes stated he did not use approximately $18,000 of the ARPA funds designated for WHH Park expenses. He advised Marta Fryman to keep those funds in the General Fund to absorb costs of the bobcat, village expenses and fuel used at the park. Skip stated he will contract with an outside company for any large projects. Dave Moorman stated his main concern is that the Aston Oaks roads are not old enough to qualify for any grants. That funding will come out of the general fund. Light, Water and Sewer - Mrs. Romweber No Report. Maintenance - Mr. Bonner Joe stated Turnberry Drive, St. Annes and Eagles Cliff roadwork is being completed this month. Police & Fire – Mr. Deters No Report. Planning & Zoning - Mrs. Bolser Bev asked our maintenance department to order the “No Thru Trucks Over 2 Tons” signs and install them on Cliff Road. Law & Ordinance - Mr. Weadick No Report. Beautification – Mrs. Romweber Fran will speak with Nate about the basket that was stolen and have a security measure in place. COUNCIL’S OLD BUSINESS There was a discussion on Ordinance 2024-2 Authorizing the Placing of “NO PARKING” Signs in the Curve of Turnberry Drive in the Village of North Bend. Mayor Sammons visited the owner of 20 Turnberry Drive and he was not receptive to his visit. Mayor Sammons tried to explain to the owner that several cars are parked in the curve of Turnberry and this causes a safety issue. It has also been stated that he may be operating a business out of his home. Joe Bonner stated the AOPOA may be contacting him regarding this issue. Dave Moorman stated maybe North Bend could recommend the owner place a “pull off” area on his property at the curb down from his residence. Fran Romweber is not in favor of this remedy and recommended placing yellow paint on the curb; which would forbid parking in that area. Minutes, August 19, 2024 COUNCIL’S OLD BUSINESS, Continued Mark Weadick said we do not have a safety expert stating this is a safety hazard. The home owner purchased the property with no parking restrictions on his street. Mayor Sammons will reach out to Miami Township Fire Department for professional safety advice. Joe Bonner made a motion to suspend the third reading of Ordinance 2024-2. Fran Romweber seconded the motion. Motion carried 100%. (5-0) Fran Romweber stated we received the signed return receipt from Dollar General’s Corporate office; they received our letter regarding their trash issue and the condition of their building. Joe Bonner stated they have already placed a new gate to their trash bin location. Bev Bolser asked if Mayor Sammons has heard anything more regarding the Derbyshire development on St. Annes. Mayor Sammons has not received the geotechnical report from Mr. John Niehaus. Dave Moorman completed an Information Bulletin on the Fire & EMS Ballot Issue. He will talk with Marilyn about mailing the information to residents. LAW DIRECTOR’S OLD BUSINESS Mayor Sammons has contacted Mr. Alutto of Hamilton County regarding sending us a new police contract showing the CAP we are requesting. There was a discussion of Resolution 2024-23 Imposing a Seventh Extension of an Additional ONE YEAR Moratorium on the Issuance and Processing of Any Permits Allowing Retail Dispensaries, Cultivators, or Processors of Medical or Recreational Marijuana Within the Village of North Bend. Mayor Sammons spoke about the 10% fee the State of Ohio is charging on all marijuana sales and that each community that houses a dispensary will receive 3.6% of their income (which is reported to be 20-30 million annually). That would result in approximately $600,000 for North Bend. Their facility must be well maintained and fit in with the community. Dave Moorman stated many communities are requiring dispensaries be a certain distance from schools and churches. There are now 300 licenses for dispensaries available in Ohio. Scott Sollmann recommended passing the resolution and then if council would like to consider it further, they can discuss proper locations and rescind the resolution. Joe Bonner made a motion to declare Resolution 2024-23 an emergency and to dispense with the requirement that this resolution be read on three separate days and be adopted upon its first reading. Bill Deters seconded the motion. Motion carried 100%.
