MAYOR’S OPENING STATEMENT
Mayor Sammons reviewed our “Breakfast with Santa” event which was held December 13th in
Council Hall. Attendance was great (40+) and well received by all. Mayor Sammons thanked everyone for their help and donations. Ron Hartoin thanked the Mayor and his wife for their work on this important event.

Bill Welch moved that the November, 2014 Minutes be accepted. Ron Nunnery seconded the motion. Motion carried 100%.

MAINTENANCE SUPERVISOR’S REPORT
The Maintenance Supervisor’s Report is available at the Village office.
Rick Schultz is working with John Niehaus regarding a tree that needs trimming because it’s hiding the view of a new Stop sign at the top of Aston Oaks Drive.
Aston Oaks will reimburse North Bend for a portion of the new signage cost for the entire project.
POLICE REPORT
No Report. Mayor Sammons asked for prayers for the two police officers slain in New York City.

FIRE REPORT
Chief Ober stated there were 13 EMS runs and 3 fire runs. The 2014 inspections are complete.
The hydrant on US 50 at the Addyston boundary line is currently turned off due to leaking water, however, it can be used if needed. The location of this hydrant is not vital for the safety of residents. Chief Ober said Addyston is responsible for repairing that hydrant.
There are also three other hydrants that need to be repaired that are the responsibility of Cleves Water Works. The Chief has no authority to force Cleves to repair the hydrants. Chief Ober says none of these hydrants are causing an urgent safety issue. Jim Reichert asked Chief Ober to prepare a directive to have them repaired and send to North Bend. North Bend will follow up with Cleves.
THREE RIVERS SCHOOL DISTRICT
Kate Fenton stated the search for a new Superintendent is continuing and will be announced in the next few days.
The artist contest for the Presidents’ portraits for North Bend’s Council Hall is being developed.
Plans are underway for President William Henry Harrison’s celebration in February.
The Kiwanis Spring Fling is coming in February at Miami Township Community Center.

Light, Water and Sewer - Ms. Smith
Shirley Smith read a report from JMA for recommendations for the project on US 50 and St. Annes for the installation of curbs, storm pipes, catch basins and more improvements. The project would cost approximately $237,000, minus possible grants.

Law & Ordinance - Mr. Moorman
There was a discussion regarding the status, fines and assessments of three remaining properties.
The owner of 3 Miami Avenue paid the fine and provided the required Residential Rental Application and Checklist. Dave Moorman recommends dropping the tax assessment on this property.
The owner of 464 Three Rivers Parkway property transferred ownership to their tenants. Dave Moorman recommends waiting for the 120 day deadline that Hamilton County Health Department has placed on that property for the septic system to be repaired or replaced. If the new owner pays the $500.00 fine and repairs the septic system, Dave recommends dropping the tax assessment on this property. Fran Romweber commented on the appearance of their property. Dave Moorman stated they will not respond to any correspondence from the Village. There was a discussion about what can be done. Jim Reichert has made several recommendations in the past and does not currently recommend a forced foreclosure based on the tax lien.
The owner of 35 Ridge submitted a Residential Rental Application and Checklist after renting long term without a permit. Dave Moorman recommends if the owners do not pay the $500 fine, North Bend should place the additional tax lien on the property.
Bill Welch asked about the issue regarding a different property on Three Rivers Parkway housing more than four animals. Dave Moorman stated the SPCA investigated to make sure the animals were being fed and sheltered properly. Bill has witnessed six adult dogs on the property. Mayor Sammons recommends sending a letter to the property owners advising them that a fine being imposed.
A complaint was received from a resident on St. Andrews regarding noise and excessive dust accumulating on Saturdays from a commercial operation on Three Rivers Parkway. There was a discussion about the situation and Rick Schultz will take the lead and approach the business to explore a solution.
Beautification – Fran Romweber
Fran Romweber reported that North Bend has received an $18,420 grant from Interact for Health for lighting and shade structures for the Presidential Community Playground. Fran
discussed the plan for the playground improvements. Council thanked Rick, Marilyn and Fran for their work in obtaining this grant.

Dave Moorman made motion to adopt Resolution 2014-28 Directing the County Auditor to Remove from the Tax Duplicate the Assessment Lien Placed Upon the Real Estate Known as 3 Miami Avenue in North Bend, Hamilton County, Ohio, Auditor’s Parcel No. 573-0003-0057.
Bill Welch seconded the motion. Motion carried 100%.
Dave Moorman made motion to adopt Resolution 2014-29 Further Assessing Fines on 35 Ridge of $56,400. Bill Welch seconded the motion. Motion carried 100%.

After the December Council meeting, Jim Reichert, our Law Director, combined Resolution 2014-29 and 2014-30 into one Resolution. Resolution 2014-29 Assessing Fines Incurred by Property Owners Continuing to be Renting without a Rental Permit, with attached reports, Exhibit A, Exhibit B and Exhibit C.

Jim Reichert will be retiring as North Bend’s Law Director as of December 31, 2014. He has had twenty years combined service with North Bend. He presented gifts to each Council member from his “Santa Bag” and gave a short, comical, talk with each member.
MAYOR’S NEW BUSINESS/ REPORT
Mayor Sammons presented Jim with a retirement gift card and thanked him for his service, his advice and his expertise throughout his twenty years with North Bend.
Mayor Sammons thanked everyone for their work in obtaining grants from Interact for Health. He also thanked We Thrive for their help with the playground and in recognizing North Bend.
Mayor Sammons thanked Queen City Wheels for their $250.00 donation.

This was a quiet period in the North Bend financial world since last month’s meeting. Things will change soon as we approach year end and get ready for 2015.
We wrote one purchase order this month for $10,466.09 to R.A. Miller construction for the final payment for the Shady Lane project. The $130,826 project consisted of an $82,000 grant from the County Municipal Road fund and $55,826 from village funds. The Mayor is pursuing grants to offset the Village portion,
I would like to take this moment to thank Jim Reichart for his service to North Bend and to me personally for his expertise and guidance during the time we have worked together.
Good luck to Jim in his retirement. He will be missed.

UPON THE REAL ESTATE KNOWN AS 3 MIAMI AVENUE
IN NORTH BEND, HAMILTON COUNTY, OHIO,
AUDITOR’S PARCEL NO. 573-0003-0057
WHEREAS, on February 24, 2014 the Village Council, by Resolution No. 2014-11, imposed an assessment lien on the real estate known as 3 Miami Avenue, County Auditor’s Parcel No. 573-0003-0057 located in North Bend, Hamilton County, Ohio for violation of Section 1600.01 (H) of the North Bend Code of Ordinances; and
WHEREAS, certification of the assessment was filed with the County Auditor on March 31, 2014; and
WHEREAS, the owner of the affected real estate has appealed to the Village Council for abatement and removal of the assessment, and;
WHEREAS, Council is satisfied that the owners have paid the fine recommended by the Village Rental Unit Inspector and have otherwise complied with Section 1600.01 of the Village Code;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of North Bend, _____ members elected thereto concurring that:
1) The fine paid by the owners of the real estate at 3 Miami Avenue is accepted in full payment and satisfaction of the assessment lien on Auditor’s Parcel No. 573-0003-0057.
2) The Law Director is hereby authorized to direct the County Auditor to remove from the tax duplicate the assessment lien previously placed upon the real estate at 3 Miami Avenue known as Auditor’s Parcel No. 573-0003-0057.

ASSESSING FINES INCURRED BY
PROPERTY OWNERS CONTINUING
TO BE RENTING WITHOUT A
RENTAL PERMIT
WHEREAS, the Village Rental Unit Inspector has authority for enforcement of the provisions of Title 16 of the North Bend Revised Code of Ordinances entitled Rental Units and Permits; and
WHEREAS, the Village Rental Unit Inspector has reported to Council that the owners of the real estate shown in the attached report (Exhibit “A”) are continuing to rent their real estate without rental permits in violation of Section 1600.01 of the North Bend Code of Ordinances; and
WHEREAS, the Village Rental Unit Inspector has provided written certification of continuing non-compliance by those property owners to the provisions of the Village’s Rental Unit and Permits Ordinance (Title 16, North Bend Revised Code); and
WHEREAS, the Village Rental Unit Inspector has issued repeated orders to the listed property owners that continued violation would subject them to additional fines in the amount of $150.00 per day; and
WHEREAS, the owners of the listed properties have continued to rent their properties in violation of the North Bend Ordinance and have failed to pay the fines itemized on Exhibit “B” attached, as of December 22, 2014.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of North Bend, Ohio 6 members elected thereto concurring:
That the unpaid fines incurred by the property owners as itemized in the attached exhibits shall be assessed to the properties shown on Exhibit “C” attached and the Village Law Director is hereby directed to certify the additional amounts of the unpaid fines to the Hamilton County Auditor to be collected as any other assessed tax on any other Hamilton County real estate.
