MAYOR’S OPENING STATEMENT
Mayor Sammons reviewed the National Election results and the need for the parties to work together. The Mayor noted that political party affiliation is never mentioned by Council members. Council’s goal is the prosperity of North Bend and not any individual party.

Ron Hartoin moved that the October, 2014 Minutes be accepted. Ron Nunnery seconded the motion. Motion carried 100%.

MAINTENANCE SUPERVISOR’S REPORT
The Maintenance Supervisor’s report is available at the Village office.
POLICE REPORT
Sgt. Dave Downing, standing in for Sgt. Steers, reported that there were 43 calls for the month of October. Two cases were assigned to detectives.
Mayor Sammons asked that his monthly "blotter" report resume. It’s been approximately three months since he’s received the report from the Sheriff’s office. Sgt. Downing will follow-up.
Ron Nunnery stated that the Neighborhood Watch Committee met and went over recent incident reports.

FIRE REPORT
Assistant Chief, Mike Wells, standing in for Chief Ober, reported that there were four (4) fire runs and eighteen (18) EMS runs for the month of October. The total number of fire runs is up by four (4) from last year. The EMS runs are down for the year.
Mayor Sammons asked if there are any inoperative hydrants. Dave Moorman asked if the hydrant between Rohrer’s Tavern and the North Bend boundary line has been repaired and if not, the black covering needs to be replaced. Asst. Chief Wells will follow-up.

Finance - Mr. Welch
Bill Welch reviewed the Appropriations Budget and said he could not support the $15,000 budget for the Beautification Committee due to the 25% increase over last year’s budget; it’s too aggressive. The number of baskets is increasing from 34 to 62 which is an 82% increase and this would add additional work to our maintenance staff as well. Fran Romweber provided an opposing position stating our past efforts have been recognized by our residents and as a result has increased property values in North Bend. Dave Moorman gave his support for the plan as offered.
Bill Welch made motion that Ordinance 2014-02 be declared an emergency and waive the three readings for this Ordinance. Ron Nunnery seconded the motion. Motion carried 100%. Bill Welch made motion to vote on Ordinance 2014-02 Annual Appropriation Ordinance for Fiscal Year 2015 and Ron Nunnery seconded the motion. Motion carried 100%.
Roll Call Vote:
Dave Moorman – Yea, Ron Nunnery – Nay, Bill Welch – Nay, Fran Romweber – Yea, Ron Hartoin – Yea, Shirley Smith – Nay. There was a 3 to 3 tie. Mayor Sammons voted Yea. Ordinance 2014-02 Annual Appropriation Ordinance for Fiscal Year 2015 passed 4 to 3 with Mayor Sammons’ vote.
Light, Water and Sewer - Ms. Smith
Shirley Smith read a report from the Hamilton County Public Health regarding a home on Three Rivers Parkway where a septic system is inoperative.
Ms. Lee Howard, owner of the property on Three Rivers Parkway, said she is working to transfer ownership to the current renters as they may be able to get help towards the $24,000 cost of repairing the septic system. Ms. Howard read a letter she wrote to North Bend stating her case. Dave Moorman responded by stating that this has been going on since 2012 and her presence here is the first good faith effort to resolve this situation and North Bend cannot make special arrangements for individual homeowners. He said transferring the property to the tenant could be the best solution. Mayor Sammons said there is a lien on the property and if the property is not in compliance, it should not be rented. There was an extended discussion on whether to alter the current situation after which Dave Moorman recommended that upon the septic system being repaired and the payment of a $500.00 fine, a Rental Permit could be issued.

Light, Water and Sewer, Cont’d. – Ms. Smith
Jim Reichert recommended the fine be levied, no rental permit be issued and allow her time to expedite the property transfer. Mayor Sammons asked Ms. Howard to meet with her attorney and come back with her plan within the next seven days and present it to the Mayor and Dave Moorman.
Shirley Smith then read a report from JMA regarding the replacement of a large storm water pipe under St. Annes, from Symmes to east of St. Annes. JMA will have estimates for the cost of adding new drains to the creek and full height curbs as well as moving the sidewalk back along with reworking the guardrails. The next application period is September, 2015 for funds available for July, 2016 and it would be a 50-50 split.

As was noted in the Police Report section, Ron Nunnery stated that the Neighborhood Watch Committee met and went over recent incident reports.
Planning & Zoning - Mrs. Romweber
Mr. John Niehaus presented the stamp designed for Aston Oaks ARB approval of submitted building permits.
Mr. Niehaus spoke about the water main on St. Annes. He says there is a section of the 12" water main already installed, but not being used.
Mr. Niehaus discussed the real estate sign situation at Stratford and Muirfield. Dave Moorman has had six complaints about the sign being in place for five months. Based on Dave Moorman’s research, it appears the sign is in violation of North Bend’s zoning code (available at the Village office). Mr. Niehaus believes real estate developer signs should be exempt, if not, the Code should be changed. Mayor Sammons advised Mr. Niehaus that he could propose wording changes for future consideration.
Law & Ordinance - Mr. Moorman
Dave Moorman talked about the Residential Rental Permit violations, fines and Hamilton County tax assessments for three properties that are not in compliance. Dave Moorman said that at $150/day in fines, these properties are subject to over $55,500 in fines each.
Ms. Stevens, wife of Mr. Robert Stevens, who is the owner of one of the properties, talked about her husband’s deteriorating health and about the property. Dave Moorman discussed the consequences of the owner of the property ignoring North Bend’s communication over the past two years. Dave Moorman said the Village has received a Rental Permit Application and Checklist this week from Ms. Stevens and recommends levying a $500.00 fine and in return, releasing the lien that North Bend has on the property. Ms. Stevens paid the fine and the Rental Permit will be issued and the property tax assessment will be released when the check clears.
Dave Moorman reviewed the Red Plum Flyer situation. He advised residents to call 513-731-1200 to discontinue delivery.

Bill Welch made motion to adopt Ordinance 2014-06 Reappointing Village Public Works Administrator for the Period January 1, 2015 through December 31, 2015. Dave Moorman seconded the motion. Motion carried 100%.
Jim Reichert reported on the Wayne Manufacturing bankruptcy and had a check in the amount of $586.45 which represented a portion of the $1,800.00 lost in that bankruptcy.
Jim Reichert also reported that the second parcel of land located at 430 Three Rivers Parkway will be transferred to North Bend in 2015. The County Engineer would not accept the property’s legal description as written and the original bidder recalled his winning bid which caused this delay.

Two rental property owners attended our Council meeting tonight, one of the two landlords resolved their issues. However, there are still two property owners in violation and Dave Moorman recommends the tax liens in the amount of $55,500 be allowed to continue to accrue until Rental Permits are issued to the property owners.
MAYOR’S NEW BUSINESS/ REPORT
Mayor Sammons introduced our new Law Director, Mr. Scott Sollmann and welcomed him to North Bend. Mr. Sollmann addressed Council talking about his professional and personal background. He has eight years’ experience in municipal law.

Our December 29th Council meeting will be held at 6:00p.m.
(After the Council meeting, it was noted that Council had already agreed to have the December Council meeting on Monday, December 22, at 6:00p.m., so the correction was made).
MAYOR’S FINAL COMMENTS
Mayor Sammons reminded all residents that we will have "Breakfast with Santa" on Saturday, December 13 from 10:00am – 12:00noon in Council Chambers. All donations are welcome. Mayor Sammons thanked Ron Nunnery for his generous donation to this program.
Mayor Sammons reviewed our "Light Up North Bend" celebration. Christmas carols were sung by the Taylor High School Alumni Chorus and Santa arrived on a Miami Township fire truck. Approximately thirty children attended along with their parents as Mayor Sammons lighted our gateway to North Bend.

We received our Quarterly Franchise fee from Cin Bell in the amount of $574 and our Civic grant quarterly check from Duke in the amount of $1124. Reports of the history of these quarterly checks are in your package.
The finance committee has met two times since last council meeting working on the Appropriations Budget. Later in this meeting our finance chairman, Mr. Welch, will offer a resolution for your discussion and possible adoption

1) All planters were put away for winter along with the poles and banners
2) Cleaned up plant beds at the Hillgrove property and Council Hall

Section 1: That the position of Engineer for the Village of North Bend is hereby re-established.

ORDINANCE RE-APPOINTING HAMILTON COUNTY BUILDING
COMMISSIONER TO PROVIDE INSPECTION AND OTHER SERVICES
NEEDED BY THE VILLAGE
WHEREAS, The Council of the Village of North Bend, Ohio, has determined that it is necessary to retain engineers to provide engineering and inspection services to insure that building and development comply with North Bend, Hamilton County, and State regulations;
WHEREAS, the Council of the Village of North Bend, Ohio, finds that the Hamilton County Building Commissioner has the expertise necessary to provide said services.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Ohio _____ members elected thereto concurring that:
Section 1: The Village Council authorizes the Mayor to retain the Hamilton County Building Commissioner pursuant to contract, which is included herein by reference, for the period from 1/1/2015 to 12/31/2015 for the purpose of approving plans, drawings, specifications and data; issuing permits and making inspections for any and all building and other structures erected within the Village, as provided in said Building Codes.
Section 2: It is further provided that the fee schedule adopted by the County for such review, inspection and approval services shall apply to the Village. Fees paid by the Village of North Bend regarding the Aston Oaks development are to be recovered from the developer of the Aston Oaks Project pursuant to ordinance passed in December of 1992.
Section 3: This Ordinance is hereby declared to be an emergency measure necessary to preserve the health, safety and general welfare of the Village and that by reason thereof it shall become effective immediately.

Ordinance appointing the Village Law Director
for the period January 1, 2015 through December 31, 2015
WHEREAS, the Council of the Village of North Bend, Hamilton County, Ohio has determined that the position of Law Director is necessary to effectively handle legal matters on behalf of the Village; and
WHEREAS, the Council has determined that Scott Sollmann, an Attorney licensed to practice law in the State of Ohio, can fulfill said duties;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Hamilton County, Ohio _____ members elected thereto concurring:
Section 1: That the position of Village Law Director is hereby re-established; and
Section 2: That Scott Sollmann is hereby appointed pursuant to Ohio Revised Code § 733.48(A) to fill the position of Law Director and that he shall perform all the duties and functions required of him by law as Law Director pursuant to Ohio Revised Code § 705.11and shall (a) attend at least one Council meeting per month and (b) render legal advice and perform all drafting necessary to prepare all Ordinances and Resolutions of the Village Council and (c) act as legal advisor to the Mayor and Village Council in all matters where legal advice and counsel may be required.
Section 3: That the compensation for such legal services as Village Law Director shall be billed monthly at the rate of One Thousand Two Hundred Fifty ($1,250.00) Dollars per month. Extraordinary services as in litigation and court appearances shall be billed at the rate of One Hundred Seventy-five ($175.00) Dollars per hour and billed via monthly invoices as well. The Village Law Director will be considered a part-time employee of the Village for purposes of the Ohio Public Employees Retirement System ("OPERS") and the Village shall pay the Employer’s portion of the contributions to OPERS and deduct from the payments to the Village Law Director all necessary local, state, and federal deductions with respect to this position..
Section 4: This Ordinance is hereby declared to be an emergency measure necessary to preserve the health, safety and general welfare of the Village and that by reason thereof it shall become effective immediately.

RESOLUTION 2014-23
RESOLUTION AUTHORIZING THE MAYOR
TO ENTER INTO AN AGREEMENT WITH
MIAMI TOWNSHIP FOR SHARING THE
EXPENSE FOR USE OF SALT LOADER
WHEREAS, the Village benefits from the use of the Miami Township salt loader; and
WHEREAS, it is necessary for the Village to use a rubber-tire loader in order to efficiently load salt into North Bend’s salt spreading trucks during the winter season; and
WHEREAS, Miami Township has purchased a rubber-tire loader for use at the Miami Township salt storage dome by the Village of North Bend, the Village of Cleves, Miami Township and the Village of Addyston; and
WHEREAS, the Miami Township Trustees have suggested the each of the above named governmental entities should share equally in the cost for use and maintenance of the salt loader; and
WHEREAS, Council has determined that use of the salt loader will benefit the citizens of the Village and will promote their safety and welfare.
IT IS NOW THEREFORE RESOLVED, by the Council of the Village of North Bend, Hamilton County, Ohio 6 members concurring that the Mayor is authorized to enter into an agreement with Miami Township to:
1) Pay for the Village’s share of the cost for use of the salt loader up to the amount of Two Thousand ($2,000.00) Dollars;
2) Pay Miami Township within thirty (30) days of receipt of the invoice from the Township; and
3) Pay 25% of any reasonable unforeseen additional costs for needed repairs and maintenance.

WHEREAS, it is the desire of the Village of North Bend to enter into a contract with the Hamilton County Regional Planning Commission for zoning and compliance services; and
WHEREAS, the Hamilton County Regional Planning Commission is agreeable to the furnishing of said services upon the terms and conditions as set out in the contract hereto attached and marked Exhibit A; and
WHEREAS, it is the opinion of Council that said contract is for the benefit, safety and welfare of the Village of North Bend and its residents and property owners;
NOW, THEREFORE, BE IT RESOLVED by vote of the Council of the Village of North Bend, _____ members elected thereto concurring:
Section 1: That the Mayor of the Village of North Bend is hereby authorized to enter into the contract with the Hamilton County Regional Planning Commission, attached as Exhibit "A", effective 1/1/15 through 12/31/15.

RESOLUTION APPOINTING VILLAGE STREET COMMISSIONER
WHEREAS, Section 735.31 Ohio Revised Code requires the Mayor of the Village to appoint a Village Street Commissioner with the approval of Council; and
WHEREAS, the Council for the Village has determined that it is necessary to appoint a Council member to perform the duties of Street commissioner; and
WHEREAS, Council Member _______________ has indicated to Council that he is willing to perform the duties of the Village Street Commissioner;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of North Bend, Hamilton County, Ohio _____ members elected thereto concurring that:
_______________ be and hereby is appointed Street Commissioner for the Village of North Bend, Ohio, for a period of one year, beginning January 1, 2015; and that:
_______________ shall perform all of the duties of the Village Street Commissioner including the inspection and supervision of maintenance, repair, replacement, construction and reconstruction of all streets and sidewalks in the Village.
That _______________ shall have as part of his duties the authority to issue maintenance and repair orders, as well as to issue citations to any person, firm, or business that fails to properly maintain or repair any sidewalk or street as required by Title 4 of the North Bend Revised Code of Ordinances.
